Nigeria Advances Intellectual Property Protection with the Introduction of the Geographical Indications Bill

Nigeria has recently made significant strides in intellectual property protection with the successful submission of the approved draft of the Geographical Indications (GI) Bill on November 18, 2024. As reported by Rita Anwiri Chindah, one of the members of the Nigerian Technical Working Group on Geographical Indications, this achievement follows three and a half years of dedicated efforts and collaboration among various stakeholders, including the Nigerian Technical Working Group on Geographical Indications and support from the Afripi project and the European Union Intellectual Property Office (EUIPO). This new legislation is set to transform Nigeria’s intellectual property landscape by protecting its unique products and cultural heritage.

Understanding Geographical Indications

Geographical Indications are distinctive identifiers for products that originate from specific geographical locations, where the quality, reputation, or other characteristics of the product are essentially attributable to that origin. In Nigeria, products such as Nsukka yellow pepper, Badagry coconut, Taraba honey, and Argungi fish exemplify items that could benefit from GI protection. This legal framework aims to safeguard these high-quality products, enhancing their marketability both domestically and internationally.

The Importance of a Sui Generis Law for Nigeria

The establishment of a robust GI law in Nigeria is crucial for several reasons:
